3. Service Description
Yatakorn Law provides inheritance-related legal guidance and assistance to families and individuals in Thailand. Our services are designed to help clients navigate estate matters in a calm, clear, and considered manner.
The services currently offered include:
- Heirship Guidance — advice and explanation of heirship matters, including a written summary. Typically completed within one to two weeks from the date of engagement.
- Succession Document Assistance — assistance with reviewing and managing succession-related documents. Timelines vary depending on the complexity of the estate.
- Disagreement Resolution Support — considered support in matters where there is a disagreement over an estate. Each case is assessed individually. Fees start from ฿4,110 and are confirmed in writing after initial assessment.
Our services are intended for clients based in or with estate interests in Thailand. If your matter involves foreign jurisdictions, we will discuss the scope of our involvement with you before any engagement is confirmed.
The information on this website is provided for general orientation only and does not constitute formal legal advice. Formal advice is provided as part of a confirmed engagement.
4. User Responsibilities
When using our website or engaging our services, you agree to:
- Provide accurate, complete, and truthful information when making an enquiry or during the course of a service engagement.
- Inform us promptly of any changes to information you have provided that may affect the service.
- Respond to our reasonable requests for information or documentation in a timely manner.
- Use this website and its content for lawful purposes only.
- Refrain from misrepresenting your identity, authority, or relationship to the estate matter.
- Not use the website to transmit any harmful, offensive, or misleading information.
- Not attempt to gain unauthorised access to any systems or content associated with this website.
Where delays arise due to late or incomplete information provided by you, we will not be responsible for any impact on agreed timelines.
5. Intellectual Property
All content on this website — including text, layout, design elements, and written materials — belongs to Yatakorn Law or its content suppliers and is protected under applicable Thai intellectual property law.
You are granted a limited, non-exclusive, non-transferable licence to view the content on this website for your personal, non-commercial use. This licence does not include the right to reproduce, distribute, modify, or create derivative works from any part of the website without our prior written consent.
Written materials produced specifically for you as part of a service engagement (such as a written overview or document summary) are provided for your use in the context of that engagement. They may not be shared with third parties or used for any purpose other than the matter for which they were prepared, without our consent.
If you believe any content on this website infringes your intellectual property rights, please contact us at [email protected].
6. Payment Terms
Our fees are stated in Thai Baht (฿) and are as follows for our standard services:
- Heirship Guidance — ฿1,450
- Succession Document Assistance — ฿2,810
- Disagreement Resolution Support — starting from ฿4,110 (confirmed in writing after assessment)
Payment terms and accepted methods will be confirmed at the time of engagement. We do not begin substantive work until payment terms have been agreed in writing.
For fixed-fee services, payment is typically required before or at the start of the engagement. For matter-specific services, staged payment arrangements may be agreed.
Refunds, where applicable, will be considered on a case-by-case basis. We aim to handle any concerns about fees with care and fairness. Please contact us at [email protected] if you have any questions about a payment.
7. Service-Specific Terms
Heirship Guidance
This service includes one private consultation and a written summary. The timeline of one to two weeks is an estimate and may vary depending on the complexity of the estate and the availability of information. The written overview is provided for the client's reference and is not a formal legal opinion.
Succession Document Assistance
The timeline for this service depends on the estate's circumstances and the documents involved. We will keep you informed of progress. Any documents reviewed or prepared remain the property of the relevant estate or beneficiary; our role is one of assistance and guidance, not execution of any formal legal deed unless specifically agreed in writing.
Disagreement Resolution Support
Before this service proceeds, we will carry out an assessment of the matter. The scope and fee will be agreed in writing before we begin. This service does not commit us to court representation unless separately agreed. Our aim is to support an orderly and respectful resolution process.
8. Confidentiality
We take the privacy and confidentiality of your matter seriously. Information you share with us during an engagement is handled with discretion and is not disclosed to third parties except:
- Where necessary to provide the service (for example, to courts, government offices, or other parties directly involved in your matter, with your knowledge);
- Where required by Thai law or a court order;
- With your explicit consent.
We ask that you also treat any advice, assessments, or written materials we provide as confidential to your matter. Please refer to our Privacy Policy for further detail on how personal data is handled.
9. Disclaimers
The information on this website is provided in good faith for general information purposes. It does not constitute formal legal advice and should not be relied upon as such without a confirmed engagement.
We make no representation that any particular outcome will result from the use of our services. Each estate matter is distinct, and results depend on the specific facts and circumstances of each case.
While we take care to keep the content on this website accurate and current, we do not warrant that it is complete, error-free, or up to date at all times. Laws and regulations in Thailand may change.
We are not responsible for the content of any external websites linked to or from this site.
10. Limitation of Liability
To the extent permitted by Thai law, Yatakorn Law's liability for any claim arising out of or in connection with our services is limited to the fees paid by you for the specific service to which the claim relates.
We are not liable for indirect, consequential, or incidental losses, including loss of opportunity, loss of expected inheritance, or reputational harm, except where such liability cannot be excluded by law.
Nothing in these terms limits our liability for fraud, willful misconduct, or any liability that cannot be limited under applicable law.
Events outside our reasonable control — including changes in law, court delays, or the actions of third parties — do not constitute a breach of our obligations.
11. Indemnification
You agree to hold Yatakorn Law harmless from any claims, losses, or expenses (including reasonable legal costs) arising from:
- Your breach of these Terms and Conditions;
- Inaccurate or incomplete information you have provided to us;
- Any misuse of the website or its content;
- Your infringement of any third party's rights in connection with your use of our services.
This indemnification does not apply to the extent that a claim arises from our own negligence or misconduct.
12. Termination
Either party may bring a service engagement to a close by providing reasonable written notice, subject to the terms of any engagement letter in place.
We may decline to continue with an engagement, or to accept a new enquiry, where we determine that we are unable to assist appropriately — for example, due to a conflict of interest or limitations in our scope of practice.
On termination, any outstanding fees for work completed to that point become due. We will provide a summary of the work carried out if requested.
Sections of these terms that are intended to survive termination — including confidentiality, intellectual property, and limitations of liability — continue in force after any engagement ends.
13. Dispute Resolution
We value the relationships we build with our clients and hope that any concern or disagreement can be resolved through open and respectful conversation.
If a dispute arises, we ask that you first contact us in writing at [email protected] so that we have the opportunity to address the matter informally.
If informal resolution is not possible, disputes will be subject to the jurisdiction of the courts of Chiang Mai Province, Thailand. These Terms and Conditions are governed by and construed in accordance with the laws of Thailand.
Where both parties agree, mediation through an appropriate Thai mediation body may be used as an alternative to court proceedings.
14. General Provisions
Entire Agreement. These Terms and Conditions, together with any engagement letter or written confirmation, constitute the entire agreement between us with respect to the subject matter and supersede any prior understanding.
Severability. If any provision of these terms is found to be unenforceable, the remaining provisions continue in full force.
Waiver. A failure to enforce any provision of these terms on a particular occasion does not constitute a waiver of that provision going forward.
Assignment. You may not assign or transfer your rights under these terms without our prior written consent. We may assign our obligations in the event of a restructuring or transfer of the practice, provided your interests are not materially affected.
Notices. Formal notices under these terms should be sent to [email protected] or by post to our registered address.
15. Changes to These Terms
We may update these Terms and Conditions from time to time to reflect changes in our services, our practices, or the applicable law.
When we make changes, we will update the "Last Updated" date at the top of this page. We encourage you to review these terms periodically.
For clients in the course of an active engagement, material changes to these terms will be communicated directly. Continued use of our website or services after any changes take effect constitutes your acceptance of the updated terms.
